Terms of Service

Effective Date: October 10, 2026

These Terms of Service (“Terms”) govern your access to and use of the CrowdGrade mobile application, website, and related services (collectively, the “Services”). The Services are owned and operated by CrowdGrade LLC (“CrowdGrade,” “we,” “us,” or “our”).

By creating an account, accessing, or using the Services, you agree to be bound by these Terms and acknowledge the CrowdGrade Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old to use CrowdGrade. We ask for your date of birth before you create an account, and you must provide your true date of birth. Where your app store provides an age range for your account, we also use it to confirm you meet this requirement. If we learn that an account belongs to someone under 18, we will delete it.

By using the Services, you represent that you are at least 18 years old and able to form a binding contract. You may not use the Services if applicable law prohibits you from doing so.

2. Accounts and Authentication

Some features require a CrowdGrade account. CrowdGrade may support passwordless email authentication and third-party sign-in methods such as Sign in with Apple, Microsoft, Google, or other supported providers.

  • You are responsible for maintaining control of the email account, Apple ID, or other identity used to access CrowdGrade.
  • You must provide accurate information and may not impersonate another person or create an account for fraudulent or abusive purposes.
  • You are responsible for activity that occurs through your account unless the activity results from a failure of CrowdGrade's systems.
  • You should notify us promptly if you believe your account has been compromised or accessed without authorization.

3. Limited License to Use CrowdGrade

Subject to these Terms, CrowdGrade grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for lawful personal use. This license does not transfer ownership of CrowdGrade software, content, trademarks, databases, or other intellectual property.

4. Card Information, Grading, and Pricing

CrowdGrade may provide card information, grading results, condition assessments, estimated values, market data, collection values, or similar information. This information is provided for informational and entertainment purposes and may be based on user input, automated systems, third-party data, historical data, community input, or other sources.

  • CrowdGrade does not guarantee that a card grade, condition assessment, identification, authenticity determination, or estimated value is accurate.
  • CrowdGrade grades or assessments are not necessarily equivalent to grades issued by professional third-party grading companies.
  • Market prices and collection values can change rapidly and may be incomplete, delayed, unavailable, or inaccurate.
  • CrowdGrade is not providing investment, financial, tax, or appraisal advice.
  • You are responsible for independently verifying information before buying, selling, insuring, authenticating, or otherwise making decisions involving a trading card.

5. User Content and Uploaded Images

The Services may allow you to upload photographs, images, text, collection information, reviews, comments, or other material (“User Content”). You retain ownership of your User Content.

By submitting User Content, you grant CrowdGrade a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, transmit, and otherwise use that User Content as reasonably necessary to operate, provide, secure, develop, and improve the Services and to provide features you request.

You represent that you have the rights necessary to upload and use your User Content and that your User Content does not violate law, privacy rights, intellectual property rights, or these Terms. Do not upload sensitive personal information that is unrelated to the intended use of CrowdGrade.

6. Community and Public Content

CrowdGrade includes community features. Cards you submit for community grading, including their photos, are visible to other users while open for grading, along with their results. Your display name, profile card, display-case cards, CrowdGrade Score, and leaderboard ranking are also visible to other users, as described in the Privacy Policy.

Photos are automatically reviewed when uploaded, and photos that appear inappropriate or do not show a trading card are rejected. Automated review is not perfect, and you remain responsible for what you submit.

If you see content that violates these Terms, use Report on the submission. You can also block another user, which hides the two of you from each other. We review reports and may remove content, reset grades or scores, or suspend or terminate accounts that violate these Terms. We are not obligated to monitor all content, but we may moderate, restrict, remove, or refuse to display any content that violates these Terms, applicable law, or the safety and integrity of the Services.

7. Acceptable Use

You agree not to:

  • Use the Services for unlawful, fraudulent, deceptive, abusive, or harmful activity.
  • Upload content you do not have the right to use or that infringes another person's intellectual property, privacy, publicity, or other rights.
  • Harass, threaten, exploit, impersonate, or mislead other users.
  • Attempt to access another user's account without authorization.
  • Circumvent security, authentication, rate limits, access controls, or technical restrictions.
  • Probe, scan, interfere with, disrupt, overload, or compromise CrowdGrade systems or infrastructure.
  • Use automated tools to scrape, harvest, copy, or extract substantial portions of the Services or data except with our written permission.
  • Reverse engineer, decompile, disassemble, copy, modify, or create derivative works from CrowdGrade software except to the extent such restrictions are prohibited by law.
  • Use CrowdGrade data or systems to train or operate competing services at scale without our written permission.
  • Introduce malware, malicious code, or content intended to damage or interfere with the Services.
  • Upload sexual, violent, hateful, or otherwise objectionable content, or photos that do not show the trading card being submitted.
  • Submit photos of cards you do not have, or photos taken from someone else without permission.
  • Manipulate community grades, scores, or leaderboards, including by coordinating grades with others, using multiple accounts, or grading dishonestly.
  • Submit false or abusive reports.

8. Intellectual Property

Except for User Content and third-party material, CrowdGrade and its software, interface, branding, designs, databases, features, and original content are owned by or licensed to CrowdGrade and are protected by intellectual property laws. No rights are granted except as expressly stated in these Terms.

9. Third-Party Content, Data, and Services

CrowdGrade may rely on or display information from third-party services, identity providers, card databases, pricing sources, cloud providers, or external websites. Third-party services are governed by their own terms and policies. CrowdGrade is not responsible for the availability, accuracy, content, or practices of third-party services.

10. Pokémon and Other Third-Party Trademarks

Pokémon, Pokémon character names, card names, logos, images, and related trademarks and intellectual property belong to their respective owners. CrowdGrade is an independent service and is not affiliated with, sponsored by, endorsed by, or officially connected with The Pokémon Company, Nintendo, Game Freak, Creatures Inc., or any other trading-card manufacturer, publisher, grading company, marketplace, or rights holder unless expressly stated otherwise.

References to third-party products or trademarks are used only to identify or describe compatible products, cards, or information.

11. Beta and Pre-Release Features

CrowdGrade may make beta, TestFlight, experimental, preview, or pre-release features available. These features may contain bugs, change without notice, lose data, perform inconsistently, or be discontinued. You use beta and pre-release features at your own risk and should not rely on them for critical records or transactions.

12. Service Availability and Changes

We may modify, update, suspend, restrict, or discontinue all or part of the Services at any time. We may change card databases, grading logic, pricing sources, features, limits, storage practices, or technical systems as CrowdGrade evolves. We do not guarantee that any feature, card record, image, price, grade, or other information will always be available.

13. Account Suspension and Termination

We may suspend or terminate access to CrowdGrade if we reasonably believe you have violated these Terms, created security or legal risk, abused the Services, or engaged in fraudulent or harmful conduct. Where appropriate, we may provide notice or an opportunity to correct the issue.

You may stop using CrowdGrade at any time. You can permanently delete your account in the app from the Account tab by tapping Delete Account. What is deleted, and what is kept, is described in the Privacy Policy. If you cannot access the app, email support@crowd-grade.com.

14. Privacy

Our collection and use of personal information are described in the CrowdGrade Privacy Policy. By using CrowdGrade, you acknowledge that Privacy Policy. The Privacy Policy is incorporated into these Terms by reference for purposes of describing our data practices.

15. No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” CROWDGRADE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND RESULTS.

CrowdGrade does not warrant that the Services will be uninterrupted, error-free, secure, complete, or free from loss, or that card information, pricing, grades, images, or other results will be accurate or current.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROWDGRADE AND ITS OWNERS, OPERATORS, AFFILIATES, SERVICE PROVIDERS, LICENSORS, AND PERSONNEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, COLLECTION VALUE, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROWDGRADE'S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID CROWDGRADE FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100 USD.

Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless CrowdGrade and its owners, operators, affiliates, service providers, and personnel from claims, liabilities, damages, losses, and reasonable expenses arising from your User Content, your misuse of the Services, your violation of these Terms, or your violation of another person's rights.

18. Governing Law

These Terms will be governed by the laws of Texas, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

19. Changes to These Terms

We may update these Terms as CrowdGrade evolves. If we make material changes, we may provide notice through the app, website, email, or another reasonable method. The updated Terms will state a new effective date. Where required by law or appropriate for material contractual changes, we may ask you to affirmatively accept the updated Terms.

20. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms without our consent; CrowdGrade may assign them as part of a merger, reorganization, financing, sale of assets, or similar transaction, subject to applicable law.
